Welcome to bringnatureinside.blog. This website is owned and operated by Aparna Vijayakrishnan (Einzelunternehmen), based in Germany. Throughout these Terms and Conditions, “we”, “our”, and “us” refer to Aparna Vijayakrishnan (Einzelunternehmen). By accessing this website, booking a consultation, or purchasing our digital products, you agree to be bound by these Terms in full. If you do not agree, please do not use the site or our services.
1. Scope and Applicability
These Terms govern use of bringnatureinside.blog, our online garden consultation services, and all digital products (e.g., guides, templates, online courses). Additional or product-specific terms may apply and will be presented prior to purchase.

3. Products and Services
We offer (a) Digital Products (e.g., downloadable guides, templates, courses) and (b) Garden Consultation Services delivered remotely (video call, email).
The scope, duration, deliverables, price, and any support period for your booking are as described in your booking confirmation or invoice. Unless expressly stated, no in-person site work is included.
4. Orders, Bookings, and Payments
Payments are processed securely by third-party providers (e.g., Stripe, PayPal). We do not store card data. Prices are shown in Euro and may include/exclude taxes depending on your jurisdiction. Your bank/payment provider may charge currency or processing fees.
For consultations, your booking is confirmed only after successful payment and receipt of our confirmation email/calendar invite. Please ensure your contact details and time zone are correct.
5. Delivery
Digital Products: access via download link or account after payment (usually instant; up to 24 hours possible due to technical factors).
Consultations: provided on the scheduled date/time via the stated platform (e.g., Zoom/Google Meet). If a call cannot proceed due to technical issues on either side, we will reschedule at no cost to the next mutually available slot.
6. Cancellations, Rescheduling, and No-Shows (Consultations)
Rescheduling — always possible: You may reschedule at any time, as often as needed, and free of charge, up to the scheduled start time using the link in your confirmation or by emailing us. If you miss the start time, your session remains valid and can be rescheduled without fees.
Validity window: Each paid session remains reschedulable and valid for 6 months from purchase (unless a longer period is stated in your booking confirmation).
Cancellations:
≥48 hours before the appointment: full refund on request, or keep a session credit.
<48 hours: no monetary refund, but the full session credit remains reschedulable within the validity window.
No-shows: Not forfeited; you may still reschedule at no cost within the validity window.
Availability: We cannot guarantee a specific day/time, but we will offer the next mutually available slots.
Your statutory right of withdrawal (see §8) remains unaffected.
7. Refund Policy (Digital Products)
Due to the nature of digital content, all sales are final once access has been provided. In the EU, you have a 14-day right of withdrawal for distance contracts; however, if you explicitly consent to immediate access and acknowledge losing your withdrawal right, the right is waived.
8. EU Right of Withdrawal for Services (Consultations)
EU consumers have a 14-day withdrawal right for service contracts concluded online. If you ask us to start the service during the withdrawal period, you acknowledge that:
if the service is fully performed within the 14 days, the right is lost;
if performance has begun but is not completed, you owe a proportionate amount for services already provided.
Instructions on how to exercise this right are provided with your booking confirmation.
9. Client Responsibilities (Consultations)
You agree to provide accurate information (e.g., photos, measurements, light exposure, constraints); obtain any required permissions/permits (e.g., landlord/HOA rules, local regulations); ensure structural safety (e.g., balcony load limits) and safe access to water/power; and follow our written guidance for plant care. We rely on your inputs; incomplete or inaccurate information may limit results.
10. Deliverables and Support
Where deliverables (e.g., plan/layout/plant list) are included, they are tailored to your inputs and local conditions and are provided as described in your booking confirmation or invoice. Any support window (e.g., email/chat Q&A) begins after delivery of the final plan for your booking and covers reasonable questions related to that plan. Meeting recordings are only made with prior consent.
11. Gardening Disclaimer (Results Not Guaranteed)
Horticulture outcomes vary with weather, pests/diseases, water quality, microclimate, maintenance, soil, and seed/plant quality. We do not guarantee yields, survival, or timelines. Our services do not include structural engineering, pest control, arborist services, or chemical safety advice.
12. Health, Safety, and Environment
You are responsible for safe use of tools/materials, allergy considerations, child/pet safety, disposal of substrates/containers, and compliance with local water restrictions and environmental rules. Use protective gear and follow manufacturer instructions.
13. Third-Party Providers and Contractors
We may recommend suppliers or contractors, but any purchase or engagement is solely between you and the third party. We are not responsible for third-party availability, quality, or warranties.
14. Intellectual Property and License
All site content, designs, plans, images, and materials are owned by xyz (Einzelunternehmen) or our licensors.
Digital products: licensed to you for personal, non-commercial use; no redistribution, resale, or public sharing.
Consultation deliverables (plans, layouts, plant lists): licensed for personal use at the specified property only. You may not resell, publish, or reuse them for other properties or clients without written permission.
15. Testimonials, Photos, and Portfolio Use
With your consent, we may feature anonymized before/after photos or testimonials. You can withdraw consent at any time for future use by emailing us.
16. Privacy
We process personal data as described in our Privacy Policy (Datenschutzerklärung). By using our site/services, you consent to such processing. We may use third-party tools (e.g., video conferencing, scheduling, email marketing) to deliver services.
17. Disclaimer – No Legal/Engineering/Medical Advice
Information on this website and in our products/services is for general educational purposes. It is not legal, financial, engineering, medical, or pest-control advice. Please seek qualified professionals where appropriate.
18. Limitation of Liability
To the fullest extent permitted by law, we shall not be liable for indirect, incidental, or consequential damages arising from the use of our site, products, or services. Our total aggregate liability for any claim shall not exceed the amount you paid for the specific product or service giving rise to the claim. Nothing limits liability for intent, gross negligence, or injury to life, body, or health where such limitations are unlawful.
19. Changes to Services and Terms
We may modify content, features, or pricing at any time. We may also update these Terms; the “Last updated” date reflects the latest version. Continued use after changes constitutes acceptance.
20. Governing Law and Disputes
These Terms are governed by the laws of Germany. Mandatory consumer protections of your country of residence remain unaffected. The European Commission’s Online Dispute Resolution platform is available at: https://ec.europa.eu/consumers/odr/
We are neither obliged nor willing to participate in dispute settlement proceedings before a consumer arbitration board unless required by law.
21. Severability
If any provision is found invalid or unenforceable, the remaining provisions remain in effect.
